Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Gold Life LLC, a Florida limited liability company (“Gold Life,” “we,” “us,” or “our”), governing your use of the website at softwarebygl.com (the “Site”). They do not govern our apps. My Business and My Money are licensed separately under their own terms — see the My Business Terms of Use and the My Money Terms of Use. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Please read Section 10 carefully. It contains a binding arbitration clause and a class-action waiver that affect your legal rights.

1. Who can use the Site

You must be at least 13 years old to use the Site. If you are between 13 and 18, you should have permission from a parent or legal guardian. If you use the Site on behalf of a business or organization, you represent that you have authority to bind it to these Terms.

2. What the Site is

The Site is informational. It describes Gold Life LLC and the apps we build, and it links to the Apple App Store where those apps are distributed. Nothing on the Site is sold to you here: downloads, purchases, and subscriptions all happen through the App Store under Apple’s terms and the relevant app’s own Terms of Use.

Descriptions, screenshots, feature lists, and pricing shown on the Site are provided in good faith and describe our apps as they stand when written. Software changes; what is on the App Store at the moment you buy is what governs. We may change, suspend, or discontinue any part of the Site at any time.

3. License to use the Site

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal or internal business purposes. This license does not include any right to copy, modify, distribute, sell, or lease any part of the Site, to reverse-engineer it, to use automated tools such as bots or scrapers to extract data from it, or to remove any copyright, trademark, or other proprietary notice.

4. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Infringe anyone’s intellectual property, privacy, or other rights.
  • Upload or transmit harmful code, malware, or viruses.
  • Interfere with or disrupt the Site, its servers, or its networks.
  • Attempt to gain unauthorized access to any part of the Site or its systems.
  • Misrepresent your identity or your affiliation with us.

We may investigate and take appropriate action, including blocking access and cooperating with law enforcement.

5. Intellectual property

All content, features, and functionality of the Site — including its source code, text, graphics, screenshots, logos, and overall design — are owned by Gold Life LLC or our licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. “Gold Life,” “Evolved by GL,” “My Business,” “My Money,” and related marks are trademarks of Gold Life LLC. You may not use them without our prior written permission. Apple, the Apple logo, and App Store are trademarks of Apple Inc.

6. Third-party links and services

The Site links to third-party websites and services, including the Apple App Store and our sister site evolvedbygl.com. We do not control them and are not responsible for their content, accuracy, availability, or practices. Your use of them is at your own risk and subject to their own terms and privacy policies.

7. Privacy

Our Privacy Policy explains what the Site does and does not collect. In short: there is no form or account here, the Site sets no cookies, and the only measurement is our host’s aggregate page-view and page-speed reporting. Each app’s own privacy policy covers that app.

8. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLD LIFE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or secure, or that its content is accurate, reliable, or complete. Nothing on the Site is legal, tax, accounting, or financial advice.

9. Limitation of liability and indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLD LIFE LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATING TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so these may not apply to you in full.

You agree to defend, indemnify, and hold harmless Gold Life LLC and its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

10. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at support@softwarebygl.com and try to resolve the dispute informally for at least 30 days. If it is not resolved, you and Gold Life agree to resolve any claim through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Leon County, Florida or conducted remotely. Either party may still bring a qualifying claim in small-claims court or seek injunctive relief to protect intellectual-property rights. You and Gold Life agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative action. You may opt out of this arbitration agreement by sending written notice to the email above within 30 days of first accepting these Terms. Any claim not subject to arbitration must be brought exclusively in the state or federal courts located in Leon County, Florida.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above will reflect any change, and for material changes we will provide reasonable notice. Your continued use of the Site after changes take effect constitutes acceptance.

12. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Gold Life LLC regarding the Site and supersede any prior agreements about it. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
